1. Acceptance of Terms

By registering an account, accessing, or using the LiftUp platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the platform.

2. Eligibility

You must be at least 18 years of age to create an account and use LiftUp. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Description of Service

LiftUp is a donation platform that allows users to create personal donation profiles and receive funds from donors. The platform processes payments through PayPal. For each donation received, 85% of the donation amount is transferred to the profile owner's PayPal account, and 15% is retained by LiftUp as a platform fee to cover operational costs.

LiftUp does not guarantee that you will receive any donations, and we are not responsible for the content of donor messages or the identity of donors.

4. User Responsibilities

You agree to:

• Provide accurate and complete information when creating your account and donation profile.
• Maintain the confidentiality and security of your account credentials.
• Use your real identity and not impersonate any other person or entity.
• Not use the platform for any unlawful, fraudulent, or deceptive purpose.
• Not create donation profiles for causes that violate applicable laws or these Terms.
• Be solely responsible for any tax obligations arising from donations you receive.
• Not attempt to disrupt, overload, or gain unauthorized access to the platform.

5. Prohibited Uses

You may not use LiftUp to collect donations for:

• Illegal activities or the promotion of illegal substances, weapons, or controlled substances.
• Hate speech, harassment, discrimination, or content that incites violence.
• Adult content or services of a sexual nature.
• Pyramid schemes, Ponzi schemes, or other fraudulent financial schemes.
• Misleading or deceptive campaigns that misrepresent the intended use of funds.
• Any activity that violates PayPal's Acceptable Use Policy.

We reserve the right to suspend or terminate accounts found in violation of these prohibitions.

6. Fees and Payments

LiftUp is free to join and does not charge any subscription or monthly fees. Our revenue model is based solely on a 15% platform fee deducted from each donation. Specifically:

• Each donation is split: 85% goes to the profile owner, 15% goes to LiftUp.
• Payments are processed through PayPal, and PayPal's own transaction fees may apply separately.
• All amounts are in US Dollars (USD) unless otherwise stated.

You are responsible for ensuring your PayPal account is correctly linked and in good standing to receive payouts.

7. Refunds and Disputes

All donations are generally considered final and non-refundable. However, disputes may be raised through PayPal's dispute resolution process. LiftUp is not responsible for refunding donations or mediating disputes between donors and profile owners. If a donation is refunded or reversed through PayPal, the corresponding platform fee will also be reversed.

8. Intellectual Property

You retain ownership of all content you upload to your donation profile, including images, text, and other materials. By uploading content, you grant LiftUp a non-exclusive, royalty-free license to display and use that content solely for the purpose of operating and promoting the platform.

The LiftUp name, logo, and all platform design elements are the intellectual property of LiftUp and may not be used without our prior written consent.

9. Account Termination

You may delete your account at any time through the Settings page. Upon deletion, your donation profile and associated data will be permanently removed. You may also contact us to request account deletion.

We reserve the right to suspend or terminate your account at any time, without prior notice, if we believe you have violated these Terms or engaged in any conduct harmful to the platform or its users.

10. Disclaimer of Warranties

The LiftUp platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure. Your use of the platform is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, LiftUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the platform. Our total liability for any claim arising from these Terms shall not exceed the total platform fees we have collected from your donations in the preceding 12 months.

12. Privacy

Our handling of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by posting a notice on the platform or sending an email. Your continued use of LiftUp after changes take effect constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LiftUp operates, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
